What Rhode Island Law Says About Underage DUI

The following are some of the most important regulations in Rhode Island regarding underage DUI:

  • Any person over 18 years old convicted of DUI with a passenger under 13 years old may serve up to 1 year in an adult correctional facility
  • Any person under 18 years old can be required to perform 10 to 60 hours of public community service, and the juvenile’s driving license can be suspended for 6 to 18 months. A judge can also require the juvenile to attend a special course on driving while intoxicated or under the influence of a controlled substance and alcohol or drug education and treatment for the juvenile. The juvenile may also be required to pay a highway assessment fine of no more than $500.
  • Any person under 18 years old, for a second violation no matter what state it occurred in, can be subject to a mandatory suspension of his or her driving license until he or she is 21 years old, and can also be sentenced to the Rhode Island training school for up to 1 year and fined $500.
