Interstate Commercial Traffic

In 1986, the US Department of Transportation presented the Commercial Motor Vehicle Safety Act which was established to improve highway safety by ensuring that drivers of large vehicles had the proper skills and knowledge to safely do their jobs. This Act’s main goal was to establish a national standard of training, licensing, and knowledge among commercial drivers across the country. Part of that regulation included regulating DUI standards and BAC limits. The BAC for a commercial driver in every compliant state, including Rhode Island, must be below .04% alcohol by volume, and a driver may not operate a vehicle within 4 hours of consuming alcohol.

These regulations do not stop at the state line in which a driver is licensed. A commercial driver from another state can and will be charged with DUI in the state in which they violate that regulation.
