DUI Regulations on the Water
The regulations for operating a boat under the influence of drugs or alcohol are similar to those which regulate driving a vehicle. If an operator of a boat is of legal drinking age and is charged with driving with a BAC of more than .08%, they can be charged in violation of the Alcohol Boating Safety Act. The following regulations are important for anyone operating a boat:
- A person 21 years old or above who is tested for BAC over .08% is in violation of boating regulations and can be charged with a misdemeanor or felony.
- A person who causes serious bodily injury or death because of operating a boat under the influence of drugs or alcohol may be charged with a felony.
- If a person is unable to control a watercraft because of the influence of drugs or alcohol, they may be charged with a misdemeanor or felony under the Alcohol Boating Safety Act
