What is a misdemeanor?

A misdemeanor is considered to be a lesser criminal action in the United States.  More formally, misdemeanors are offenses that are punishable by less than one year in prison.  DUI is typically considered to be a misdemeanor, unless the offender has had two or more DUI convictions in the past five years.  In this case, the DUI is charged as a felony.  DUIs that cause significant bodily harm or death to another individual are also considered to be felonies.
