Police Report: Defendant was pulled over for almost hitting a stopped car. The officer described the defendant as having a strong odor of alcohol, watery eyes and a red flushed face. The defendant admitted to consuming alcohol after the officer told the defendant he had seen him in a bar a few hours earlier. The officer concluded the defendant failed all three field sobriety tests given. The defendant was arrested and asked to submit to a breath test at the police station. The defendant refused to take the test and had a prior refusal from 2006. At trial, two police officers testified the defendant was intoxicated and refused to take a breath test.

The arresting officer detected an odor of alcohol emanating from the defendant’s breath and described the defendant as having a blank stare with bloodshot and watery eyes. The defendant first stated he did not have any alcohol to drink but later admitted to drinking at a friend’s house. The defendant failed the HGN test, the walk and turn test and the one leg stand test in which he was only able to keep his foot up for 2 seconds. The defendant admitted to having a prior conviction for a DUI. While being booked at the station, the defendant threatened the officer stating, “one day we will meet each other and it won’t be good for you.”

The defendant failed the breath test at the police station with readings of .172% and .153% BAC levels.

The final test given was the One Leg Stand test in which the defendant exhibited 4 out of 4 clues of alcohol impairment.
